RULES OF THE CONTEST

Ramadan MoneyGram Online Promotion

 

Article 1: Organization

MoneyGram Payment Systems, Inc. whose registered office is located at 1550 Utica Avenue South, Suite 100 M/S MIN-8020, Minneapolis MN 55416, USA, hereinafter referred to as « The Organizer« , is organizing a prize draw with a transaction obligation from 00:00 00 15/03/2022 to 30/04/2022 at 00:00 inclusive (« Promotion Period »).

MoneyGram will offer a prepaid bank card to persons who have made at least one money transfer transaction to specific destinations during the promotion period within its digital network in the following countries: France, Spain and Germany. The chosen sender in one of these three countries (digital network and physical network) or in one of the other countries participating in the promotion only through MoneyGram’s physical network, will share an amount of 10,000 EUROS (ten thousand Euros) with the recipient of the transaction, and will thus benefit from a prize package of 5,000 EUROS (five thousand Euros).

The drawing will take place at the end of the promotion which will end on 04/30/2022 at midnight. The draw will take place on 02/05/2022.

Article 2: Conditions for participation

This mandatory game is only open to residents of France, Spain and Germany who are 18 years of age or older and have completed a money transfer transaction within the MoneyGram digital and physical network and to residents of Cyprus and Greece who have completed a money transfer transaction within the MoneyGram physical network during the Promotion Period as indicated below:

From one of the three countries mentioned above: transactions eligible for the sweepstakes are those sent to the following destinations:  Spain: Morocco, Pakistan, India, Senegal, Mali and Bangladesh; France: Morocco, Tunisia, Afghanistan, Senegal, Mali, Ivory Coast and Bangladesh;

Germany: Morocco, Turkey, Tunisia, Pakistan, Afghanistan, Albania, Kosovo, Bosnia and Bangladesh.  

Each participating country in Europe will have its own independent game rules, related to the laws and regulations in force, and will be registered locally in the usual manner.

Persons who do not meet the above conditions are excluded from the game, as well as members of the staff of  » L’Organisatrice « , and any person who has participated directly or indirectly in the design, production or management of the game, as well as their spouse and members of their family: direct ascendants and descendants or other relatives, whether or not they live under their roof.

The  » Organizer  » reserves the right to ask any participant to justify the above conditions.

Any person who does not comply with these conditions or who refuses to justify them will be excluded from the game and will not be able to benefit from his/her prize if he/she is a winner.

Participation in the game implies full acceptance of these rules.

Article 3: Conditions for participation

Participants must first answer the question posed by « The Organizer » in order to enter the game with purchase obligation. In addition, participants must have made a money transfer transaction during the promotion period to and from the destinations mentioned in article 2. All transactions made during the promotion period will be automatically eligible for the prize draw.

Any participation made contrary to the provisions of these rules will invalidate the participation. Any participant suspected of fraud may be excluded from the contest by the  » organizer  » without the latter having to justify it. Any incomplete, erroneous or illegible identification or participation, whether intentional or not, or made in a manner different from that provided for in these rules, will be considered null and void. The same penalty shall apply in case of multiple entries.

  

Article 4: Lot definitions

The prizes at stake are :

An amount of 10,000 euros (ten thousand euros) is at stake for France, Spain and Germany (digital network + physical network) and for one of the other countries participating in the promotion only through MoneyGram’s physical network and will be shared between the sender of a MoneyGram transfer and the recipient of the same transfer designated in one of the countries where transactions are eligible for the game as set forth in Article 2.

This amount of 10,000 euros will be distributed as follows:

For the winner in France, Spain or Germany (digital network and physical network) or in one of the other countries participating in the promotion only through the physical network of MoneyGram  » named sender « : One and only one Prepaid Bank Card (Prepaid Bank Card = a means of payment derived from the debit card, which has no connection to the bank account of the holder). An amount of 5000 EUROS (five thousand Euros) will be credited to this card as follows

 

  • A prepaid bank card credited with an amount of 5000 euros for all transactions made from one of the three countries, including France (digital network and physical network) to the countries specified in article 2 or from one of the other countries participating in the promotion only through the MoneyGram physical network.

For the recipient of the MoneyGram remittance initiated by the winning sender chosen from France, Spain and Germany (digital network + physical network) or from one of the other countries participating in the promotion only through the physical MoneyGram network: A second prize of 5,000 euros (five thousand euros) will be awarded to the recipient of the winning « drawn » transaction, which will be given to him/her in the form of a prepaid card « if this means of payment exists in the country of receipt » or in the form of gift vouchers to be spent locally as follows

Host country: (see article 2)

  • A prepaid bank card with a credit of 5,000 euros, if this method of payment is available, or a gift voucher to be spent in accordance with local legal requirements.

 

Article 5: Designation of winners

At the end of the promotion (as a reminder, the promotion will end on 04/30/2022 at midnight) MoneyGram’s technical teams will extract all transactions made during the promotion period from the digital and physical networks of the sending countries (France, Spain, Germany, ) and will draw the winners as follows:

  • France (except Corsica and DOM-TOM), Spain, Germany, Greece and Cyprus: 1 winner

After the drawing, MoneyGram will contact the winning sender by phone and then by email, as MoneyGram is in possession of the contact details of everyone who has made a transaction on its digital network.

Once the winning sender has been nominated and contacted, he/she will be asked to submit the recipient’s contact details for verification by MoneyGram’s technical staff to confirm the recipient’s eligibility to win the €5,000 prize.

The sender should encourage the recipient to contact MoneyGram within seven days of the winner’s announcement to confirm his or her presence and, in particular, to provide the information necessary to collect his or her prize. To do so, he/she should contact MoneyGram international via:

Article 6: Announcement of winners

The winner from one of the countries participating in the Promotion will be contacted by telephone, according to the landline or cell phone number transmitted when sending the money, knowing that one of these elements (Telephone or Mail) is essential in the process of sending a transaction.

The recipient of the transaction, once designated, must contact MoneyGram at one of the contact details mentioned in article 5, to declare its existence and also to transmit its contact details. Once received, MoneyGram staff will contact the winner to confirm the conditions of receipt of the prize.

It is the sole responsibility of the participants to provide correct contact information. The organizer is not responsible for any participant’s inability to obtain his/her prize due to missing or incorrect information. If no response is received within 24 hours, another person will be drawn, while supplies last.

 

Article 7: Conditions for the awarding of prizes

The winners undertake to accept the prizes as they are offered, without the possibility of exchanging them, in particular, for cash, other goods or services of any kind, or of transferring the benefit to a third party. Likewise, these prizes may not be the subject of compensation requests.

Winners will receive their prizes physically in person or via their physical addresses, which they will have communicated and confirmed to one of MoneyGram’s operators, when announcing their designation as winners.

« The organizer reserves the right, in the event of an event beyond its control, in particular linked to its suppliers or unforeseeable circumstances, to replace the prizes announced with prizes of equivalent value. The winner will be informed of any changes.

Article 8: Use of participants’ personal data

The data of the participants are recorded and used by « The Organizer » to record their participation in the contest and to allow the awarding of the prize.

Participants may, for legitimate reasons, object to the processing of their personal data communicated within the framework of this contest. They also have the right to object to their data being used for commercial prospecting purposes, outside of participation in this contest, a right they may exercise as soon as their participation is registered, by writing to the Organizer at the address mentioned in article 1 or by sending an email to privacyprogramoffice@moneygram.com .

In accordance with the law of 30 July 2018, as well as with Regulation n°2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (RGPD), the participant may exercise his/her right of access, rectification, deletion of data, limitation of processing, his/her right to data portability, his/her right of opposition, as well as his/her right to withdraw consent by writing to  » The organizer  » whose address is mentioned in article 1or send an email to privacyprogramoffice@moneygram.com .

Article 9: Industrial and intellectual property

The reproduction, representation or exploitation of all or part of the elements that make up the game, including these rules, is strictly prohibited. All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site, as well as on the sites accessible via hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code for the whole world. Their unauthorized reproduction constitutes an infringement punishable by law. Any unauthorized reproduction, in whole or in part, of these trademarks, logos and signs constitutes an infringement punishable by law. Participation in this game implies full and complete acceptance of these rules by the participants.

  

Article 10: Liability

The organizer cannot be held responsible in case of force majeure or force majeure beyond its control.

« The organizer cannot be held responsible for delays, losses, theft, damage to mail, lack of legibility of stamps due to postal services. Nor can it be held responsible and no recourse can be taken against it in the event of events presenting the characteristics of force majeure (strikes, bad weather, etc.) which partially or totally deprive the participants of the possibility of participating in the game and/or the winners of the benefit of their winnings.

The « organizer » and its service providers and collaborators cannot in any case be held responsible for any incidents that may occur in the use of the prizes by the beneficiaries or their guests once the winners have taken possession of the prizes.

Likewise,  » The organizer « , as well as its service providers and partners, cannot be held responsible for the loss or theft of the prizes by the beneficiaries once the winners have taken possession of them. Any additional costs necessary to take possession of the prizes shall be borne entirely by the winners, without them being able to claim any compensation from  » The organizer « , nor from the service providers or partners.

 

Article 12: Dispute and claim

These rules are governed by Belgian law.

 » The organizer reserves the right to decide in an unappealable manner on any difficulty that may arise in relation to the interpretation or application of the present regulations, it being understood that no dispute, in particular on the terms of the game, the results, the winnings or their receipt, will be accepted one month after the end of the game. Except in the case of obvious errors, it is agreed that the information resulting from the game systems of the  » Organizer  » has probative force in any dispute concerning the connection elements and the computer processing of such information relating to the game.

Any claim must be addressed to the « Organizer » within one month after the end of the game. After this date, no claim will be accepted. Participation in the game implies full acceptance of these rules.

Article 13: Agreement on testing

By express agreement between the participant and « The Organizer », the computer systems and files of « The Organizer » shall be the sole authentic source.

The computer records, kept in the computer systems of  » The Organizer « , under reasonable conditions of security and reliability, are considered as proof of the relations and communications between  » The Organizer  » and the participant.

Consequently, it is agreed that, except for obvious errors,  » The Organizer  » may rely, in particular for the purpose of proof of any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a computerized or electronic nature or format, established, received or stored directly or indirectly by  » The Organizer « , in particular in its computer systems.

The elements thus considered constitute evidence and if produced as evidence by « The Organizer » in any litigation or other proceedings, shall be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative force as any document drawn up, received or kept in writing.

Operations of any kind performed with the identifier and code assigned to a participant after registration are irrevocably presumed to be performed under the participant’s responsibility. These competition rules were submitted via the website: https://www.reglementdejeu.com.

Participants’ data are recorded and used by MoneyGram to record their participation and to enable the delivery of the prizes. The processing of personal data will be carried out for the following reasons

  • Contractual necessity for the performance of a contract, Rules of the MoneyGram Ramadan Promotion Contest to which the data subject is a party, communication and distribution of prizes to the winners (Article 6.1.b of the GDPR);

If the participant is a MoneyGram customer:

  • Legitimate interest to promote MoneyGram’s products and brand (Article 6.1.f of the GDPR);
  • Consent to MoneyGram marketing (Article 6.1.a of the GDPR) – if the participant agrees to the marketing communication.

Participant data will be stored until the drawing on 05/16/2022.

MoneyGram transfers participant information to the following countries for which there is no adequacy decision: (i) United States of America, (ii) Mexico, (iii) Indonesia, (iv) Saudi Arabia, (v) Shanghai, (vi) Brazil, (vii) Puerto Rico, (viii) Indonesia; (ix) Turkey, (x) Singapore, (xi) China, (xii) Philippines; (xii) Malaysia, (xiv) Ukraine, (xv) Dubai, (xvi) Morocco; (xvii) India; (xviii) South Africa; (xix) Nigeria; (xx) Australia; (xxi) United Arab Emirates.

Participants may, for reasons related to their particular situation, object to the processing of their personal data communicated within the framework of these campaigns. They also have the right to object to the use of their data for commercial prospecting purposes, outside the participation in this contest, which they can exercise as soon as their participation is registered, by writing to MoneyGram.

Other rights

Each Participant is entitled to:

  • Right to access Personal Data;
  • Right to rectify Personal Data if it is inaccurate or incomplete;
  • Right to restrict the processing of Personal Data if one or more of the conditions mentioned in Art. 16 of the GDPR are met;
  • Right to erasure of personal data if one or more of the conditions mentioned in Article 17 of the GDPR are met. 17 of the GDPR;
  • Right to data portability if one or more of the conditions mentioned in Art. 20 of the GDPR are met;
  • Right to withdraw consent at any time;
  • The right to lodge a complaint with a supervisory authority if the participant believes that the processing of personal data violates applicable law.
